House Judiciary subpoenas former prosecutor on Jack Smith's team to sit for deposition in September
The subpoena comes after Windom declined to answer certain questions related to the January 6 Select Committee and Fulton County District Attorney employees during his voluntary transcribed interview with the Judiciary Committee earlier this year.
House Judiciary Chairman Jim Jordan on Monday issued a subpoena to former Senior Assistant Special Counsel Thomas Windom, who was part of former special counsel Jack Smith's team, compelling him to sit before the committee for a deposition.
The subpoena comes after Windom declined to answer certain questions related to the January 6 Select Committee and Fulton County District Attorney employees during his voluntary transcribed interview with the Judiciary Committee earlier this year.
Jordan accused Windom of relying on an "unreasonably narrow interpretation of the Justice Department's testimonial authorization" rule in order to avoid answering the questions, according to a news release.
"Your reasoning is unpersuasive," Jordan wrote in the letter. "As an initial matter, authorization from an Executive Branch entity is not a necessary condition for a witness to testify before Congress. The Committee is not aware of any such Constitutional or statutory requirement, and you have offered none, conditioning a witness’s cooperation with a Congressional committee on the basis of the express authorization from his former employer."
Jordan also claimed Windom's reliance on "unidentified court orders" to excuse himself from answering certain questions was "insufficient."
"Without offering any specific reference to a court order, the Committee is unable to assess independently whether your testimony would be covered by such order and whether that order still remains in effect," Jordan wrote. "Your reliance on generalized and unspecified court orders is an insufficient basis on which to refuse to testify."
Windom is expected to be deposed on Sept. 30, 2025.
