You Vote: Should lawmakers sue Biden over student loan debt for usurping power of Congress?
Conservatives in Congress considering taking lead in litigation.
Rep. Ralph Norman (R-S.C.), an influential conservative in Congress, told the "Just the News, Not Noise" television show this week that it's time for lawmakers to sue President Biden to block his student loan forgiveness announcement, challenging the plan on the grounds that it usurps the power of Congress to make laws.
Norman said lawmakers who are home for summer recess are hearing lots of anger about the plan and suggested the conservative Freedom Caucus in the House could take the lead in litigation.
Biden announced last week that he will unilaterally cancel $10,000 of federal student loan debt for borrowers making less than $125,000 per year and up to $20,000 for Pell Grant recipients.
Critics have argued the executive branch doesn't have the power to implement large-scale student loan cancellation. They note all executive branch spending must first be appropriated by Congress and contend canceling student debt for millions of Americans via executive action violates the separation of powers fundamental to the Constitution.
