Emily Moreno sues ex-husband Rep. Max Miller alleging he posted nude photo of their daughter online

Ohio GOP Rep. Max Miller's ex-wife Emily Moreno sued her ex-husband on Wednesday over allegations that he recklessly published a nude photo of their young daughter online.

The new lawsuit is the latest part of an ongoing legal battle between Miller and Moreno, who is the daughter of Republican Ohio Sen. Bernie Moreno. Emily Moreno has also alleged that Miller physically abused her, including by placing a gun to her head and pouring hot water on her. She sought a restraining order against the lawmaker late last month.

Miller has denied all domestic violence and abuse allegations.

The lawsuit alleges Miller “recklessly published and disclosed to the world a nude image” of the child by including it as part of a Dropbox folder he gave his lawyer Aaron Minc as part of a group of documents and photos “to salvage his political job” against her claims of domestic abuse. He also shared the Dropbox on his X account.

Emily Moreno also claimed in the lawsuit that more than 400,000 people have since accessed the Dropbox folder and that she never gave Miller or Minc consent to publish the images in the Dropbox, according to The Hill. 

“Miller’s recklessness is underscored by the fact that any parent knows — in this era and world filled with pedophiles, creeps, and AI-generated image alteration and video generation — not to put nude pictures of their child, or any child, on the public internet,” she wrote in the suit.

The lawsuit comes after Minc accepted sole responsibility for the Dropbox fiasco, telling Politico last week that he was “only person responsible for assembling, creating, reviewing, adding, deleting, redacting, or making any changes to the information and files that were in this folder.”

The lawsuit asks an Ohio judge to find the pair's actions violated state and federal laws, award the daughter with $150,000 in damages and enter judgment in the daughter’s favor to all claims of relief.

The new lawsuit also comes as the couple engage in a legal custody battle over their 2-year-old daughter. The couple divorced last year.
