Erika Kirk wants speedy trial, argues Tyler Robinson defense has caused ‘undue delay’: report

Erika Kirk is seeking a speedy trial in response to what she alleges are delay tactics by the legal team representing the accused assassin of her husband Charlie Kirk, according to a court filing this weekend.  

The defendant, Tyler Robinson, is accused of shooting Charlie Kirk at a Turning Point USA event at Utah Valley University last year.

Under Utah law, victims can invoke a right to a speedy trial. "The Utah Code affords victims of a crime ‘the right to a speedy disposition of the charges free from unwarranted delay caused by or at the behest of the defendant,’" Kirk’s attorney, Jeffrey Neiman, wrote in the court filing, according to Fox News Digital. 

Prosecutors said on Friday that the discovery process is almost complete, but Robinson has not yet entered a plea or faced a preliminary hearing, an early step in any trial under Utah law where prosecutors argue before a judge that they have probable cause to bring the charges, Fox News reported.

Robinson’s defense team has also filed a motion to disqualify the team of state prosecutors over an alleged conflict of interest, that a deputy county attorney’s child was allegedly in the crowd during the shooting. The prosecutors accused the defense team of using the motion as a stalling tactic.
