Ex-New York state prison guard found guilty of murdering inmate, two others acquitted

A former New York state prison guard was found guilty of murdering an inmate, while two other guards were acquitted.

The inmate, Robert Brooks, was beaten to death by correctional officers at Marcy Correctional Facility while handcuffed last December, The Associated Press reported Monday. In February, five guards were indicted that had previously pleaded guilty to manslaughter in Brooks’ death.

A jury found David Kingsley guilty of murder and manslaughter. Mathew Galliher and Nicholas Kieffer were also charged with murder and first-degree manslaughter, but were acquitted.

Galliher and Kieffer were also charged with second-degree gang assault, but found not guilty, and Kieffer faced a fourth charge of filing a false instrument.

Brooks was beaten three separate times when he arrived at the prison, the final beating in the infirmary being the fatal one, which was caught on silent body-camera footage, according to Onondaga County District Attorney William Fitzpatrick.
