James Comey say Trump 'will probably come after me again,’ after case dismissal

Comey was charged in September with obstruction of justice and making a false statement to Congress in 2020. He pleaded not guilty to both charges.

Former FBI Director James Comey said Monday in a video on social media that the Trump administration's criminal case against him is likely not over, despite a federal judge dismissing it earlier in the day. 

Comey was charged in September with obstruction of justice and making a false statement to Congress in 2020. He pleaded not guilty to both charges.

A federal judge dismissed the case against him and New York Attorney General Letitia James, a Democrat, after finding the prosecutor who brought the cases was not lawfully appointed.

Comey claimed the case was "based on malevolence and incompetence and a reflection of what the Department of Justice has become under [President] Donald Trump.”

“A message has to be sent that the president of the United States cannot use the Department of Justice to target his political enemies," he continued in a video posted on Instagram. "I don’t care what your politics are, you have to see that as fundamentally un-American and a threat to the rule of law that keeps all of us free.

“I know that Donald Trump will probably come after me again, and my attitude is going to be the same," he continued. "I’m innocent, I am not afraid, and I believe in an independent federal judiciary.”

The White House said earlier in the day that the Justice Department will likely appeal the dismissal.
