Judge temporarily blocks deportation of Georgetown graduate student detained by ICE
Badar Khan Suri was arrested on Monday outside his home in Arlington, Virginia.
A federal judge has temporarily blocked the federal government from deporting a Georgetown University graduate student who was detained Monday by Immigration and Customs Enforcement for allegedly promoting anti-semitism and pro-Hamas propaganda.
Judge Patricia Tolliver Giles, of Virginia, ruled Thursday the detainee, Badar Khan Suri, "shall not be removed from the United States unless and until the Court issues a contrary order," according to CBS News.
Suri was arrested on Monday outside his home in Arlington, Virginia. He was informed by Department of Homeland Security authorities that his student visa had been revoked by the government.
The federal government alleges that he has close ties to Hamas and spread the terrorist group's propaganda and was "promoting anti-semitism on social media.”
Suri's attorneys filed a writ of habeas corpus and accompanying complaint challenging his detention in the U.S. District Court for the Eastern District of Virginia on Tuesday, one day after his arrest. CBS News obtained the documents Thursday.
In an order later in the day, Judge Patricia Tolliver Giles said Suri "shall not be removed from the United States unless and until the Court issues a contrary order."
Suri's lawyers have said that his detainment is unjustified and violated his due process rights.
He is being held at a detention center in Louisiana but is likely to be moved to a facility in Texas.
