Homeland Security Secretary Markwayne Mullin reminded people Tuesday that voting in the midterm elections without citizenship is illegal and that those caught doing so would be "prosecuted to the fullest extent of the law."

The warning comes after federal officials in Nevada charged five foreign nationals with voting illegally in recent elections. They were in the United States legally but did not have American citizenship.

"If you vote illegally in this country, and you are NOT eligible to vote, [the DHS] will find you, hunt you down, and you will be prosecuted to the fullest extent of the law," Mullin wrote on X. "Only American citizens should be deciding American elections."

The warning also comes the same day, Election Day, that the Ninth Circuit Court of Appeals allowed the Department of Justice to resume its efforts to have states set aside ballots cast by suspected noncitizens and continue its threats of prosecution for non-compliance.

The Ninth Circuit ruling stems from the DOJ's legal fight with California over 20,000 suspected noncitizens on its voter rolls. The government had asked the state to set those ballots aside for verification before counting them, but the matter went to the Supreme Court without the administration securing a judicial order in its favor.
