Lindsay Clancy attorney, judge spar over holdout juror

Judge William Sullivan and Lindsay Clancy defense attorney Kevin Reddington on Friday sparred over a holdout juror's alleged refusal to apply reasonable doubt to the evidence.

Clancy stands accused of murdering her three children. While she admits to the act, she has argued she suffered from severe mental illness and should not be held criminally liable. The jury has failed to reach a unanimous verdict after several days of deliberating.

Reddington, in court, pointed to a note from the jury foreman insisting that one juror was refusing to apply reasonable doubt and inferred that the juror was refusing to hold his client not guilty by reason of insanity. He further asked Sullivan to "direct their attention to proof beyond a reasonable doubt and reinstruct them on that forcefully."

Sullivan then stated that he had done so the previous day, prompting Reddington to say he had failed to do so forcefully.

"What do you want me to do? Get a brass band?" Sullivan retorted. "I read the instruction as written by the [Supreme Judicial Court]. The fact that I perhaps did not give it my full inflection, I'm sorry about that, I'm not an actor!"

He also rejected Reddington's assertion that he was "glossing over" the issue.
