Five House Republicans help kill effort to censure McIver over Newark charge

GOP Reps. Don Bacon and Mike Flood of Nebraska, Dave Joyce and Mike Turner of Ohio and David Valadao of California voted against the censure.

A group of five House Republicans on Wednesday voted with their Democratic counterparts to help kill an attempt to censure New Jersey Democratic Rep. LaMonica McIver over an assault charge in Newark.

The Justice Department charged McIver with assaulting a law enforcement officer in May after she allegedly assaulted and impeded the law enforcement officer during a protest at a U.S. Immigration and Customs Enforcement (ICE) facility in Newark. Two other Democratic lawmakers were at the protest but were not charged. 

Louisiana GOP Rep. Clay Higgins forced the vote to formally reprimand McIver on Wednesday and remove her from her post on the House Homeland Security Committee. But GOP Reps. Don Bacon and Mike Flood of Nebraska, Dave Joyce of Ohio and David Valadao of California voted against the censure. 

A spokesperson for Republican Ohio Rep. Mike Turner said Turner accidentally voted in favor of nixing the censure, according to Politico. The vote failed in a 215-207 split.

Other House Republicans previously sought to punish McIver and the other two lawmakers for their conduct at the protest, including South Carolina GOP Rep. Nancy Mace, who introduced a measure to expel McIver from Congress. Georgia Rep. Buddy Carter has moved to strip all three lawmakers of their committee assignments.

McIver has denied any wrongdoing.
