Comey's case stems from him having been indicted in the Virginia federal court on charges of obstructing Congress and making a false statement. He has pleaded not guilty to the charges.
He's challenging President Trump's appointment of Halligan as the court after former U.S. Attorney Erik Siebert resigned over pressure to indict Comey and New York Attorney General Letitia James.
