A transgender migrant who was wanted by Immigration and Customs Enforcement was charged with allegedly raping a 14-year-old boy in a bathroom at the Thomas Jefferson Park in East Harlem.

Nicol Suarez, 30, allegedly followed the 14-year-old into the bathroom at the park on Tuesday and attacked him there, according to a report from the New York Post.

The boy reportedly left the bathroom and witnesses alerted police about the incident, according to police.

Suarez, who is from Colombia originally, was arrested near the park the next day and charged with first-degree rape, the report said. ICE had put a detainer on Suarez for other charges in New Jersey and Massachusetts but the details of those cases have not yet been disclosed.

Prosecutors requested $500,000 bail and $1.5 million bond for Suarez but Judge Elizabeth Shamahs lowered the amount to $100,000 bail or $250,000 bond, according to court documents.

The New York Post reported that Shamahs was elected on the Democratic ticket and formally became a judge in January.

The story drew a comment on X from Tesla and SpaceX CEO Elon Musk.

"This judge has sympathy for criminals, but not for their victims," Musk wrote.
