Transportation secretary warns states could lose funding for infrastructure over immigration, DEI

The secretary reminded states that they have entered a legal agreement with the federal government to comply with all applicable regulations and laws, and that the government can pull funding if the recipients are not in compliance.

Transportation Secretary Sean Duffy on Thursday warned states that they could lose critical federal funding for infrastructure projects if they continue to fund diversity, equity and inclusion (DEI) programs or infringe on the administration's immigration policies. 

The threat comes as the Trump administration cracks down on states that do not align with President Donald Trump's America First policies. The administration targeted Maine recently over its refusal to ban transgender athletes from competing in female sports. 

Duffy notified states of the new policy in a letter that was addressed to "all recipients of Department of Transportation (DOT) funding." 

“Federal grants come with a clear obligation to adhere to federal laws,” Duffy said in a statement released with the letter. “It shouldn’t be controversial — enforce our immigration rules, end anti-American DEI policies and protect free speech. These values reflect the priorities of the American people, and I will take action to ensure compliance."

The secretary reminded states that they have entered a legal agreement with the federal government to comply with all applicable regulations and laws, and that the government can pull funding if the recipients are not in compliance.

"[The department] will award and continue to provide Federal financial assistance only to those recipients who comply with their legal obligations," he wrote in the letter. “DOT remains committed to advancing a transportation system that serves the public interest efficiently and unleashes economic prosperity and a superior quality of life for American families.

"This mission depends upon your strict adherence to the legal framework governing our partnership, and I trust you will take all necessary steps to comply with Federal law and satisfy your legal obligations," he added.
