Lindsay Clancy's attorney argues in court there's 'no evidence' she's responsible for deaths

Lindsay Clancy, the Massachusetts woman charged with killing her three young children, was back in court Tuesday morning for a hearing that could determine the future of the case. 

Three weeks ago, a judge declared a mistrial in the case after the jury failed to reach a unanimous verdict as a result of one juror who didn't agree she's not responsible for the killings. 

During the trial, Clancy didn't deny that she killed her children, and her attorney, Kevin Reddington, argued that she was suffering from postpartum psychosis and was overmedicated when she strangled the children and attempted to take her own life. 

Prosecutors argued that she was criminally responsible for the children's deaths and was capable of comprehending the severity of her actions. They haven't yet said if they intend to retry the case. 

On Tuesday, Reddington argued that the case should be thrown out because the prosecutors failed to prove she was responsible for their deaths, ABC News reported. 

“This entire case is based on speculation. There is no evidence that she admitted she did this," Reddington said in court.
