Comey challenges appointment of federal prosecutor overseeing false statement case

Comey was indicted on charges last month of making false statements to Congress and obstruction of a congressional proceeding. He has pleaded not guilty to the charges.

Former FBI Director James Comey on Tuesday filed a notice to the court in which he declared he would challenge the legality of the prosecutor responsible for his alleged false statement case, who was appointed by President Donald Trump last month.

Comey was indicted on charges last month of making false statements to Congress and obstruction of a congressional proceeding. He has pleaded not guilty to the charges.

Trump appointed his personal attorney Lindsey Halligan as the U.S. Attorney for the Eastern District of Virginia last month, after former U.S. Attorney Erik Siebert resigned over pressure to indict Comey and New York Attorney General Letitia James.

"James Comey, by counsel, will file his motion to dismiss challenging the lawfulness of the appointment of the United States Attorney for the Eastern District of Virginia," his attorneys wrote in the notice. 

Comey's attorneys said the official filing will take place on Oct. 20, and requested that an out-of-state judge oversee the request.
