A New York judge on Thursday declared a mistrial on a third-degree rape charge in the case against former Hollywood movie producer Harvey Weinstein, who was retried on three charges of sex crimes.

The judge declared the mistrial after the jury was unable to come to an agreement on the rape charge in connection with the case of Jennifer Mann, NBC New York reported. The jury had been deliberating on the case since June 5.

On Wednesday, the jury of seven women and five men convicted Weinstein of forcibly subjecting Miriam Haley, a producer and production assistant, to a criminal sex act in 2006, according to the Associated Press. However, the jurors acquitted Weinstein of another criminal sex act charge alleged by former Polish runway model Koja Sokola.

Following the Wednesday court decision, Mann told reporters that the partial verdict gave "hope" and "empowers others to speak out and seek justice to those predators who still believe they can exploit abuse and walk away unscathed."

Weinstein, 73, was initially convicted five years ago, but his conviction was overturned last year, and the case was sent back for retrial. The former media mogul has denied sexually assaulting or raping anyone.
